Wrongful Death. Time is of the essence. The statute of limitations varies from
state to state, so whether one lives in Nevada, California or elsewhere among
the union, it is imperative to know the Statute of Limitations in the State where
the incident or death occurred.
There are three important law principals
to consider after an incident or wrongful death:
1. Liability: Is someone
else at fault?
2. Damages: What will it take to make you whole again? Damages
are calculated based on out of pocket damages, loss of consortium, pain and suffering,
mental anguish or other compensable conditions and/or events.
3. Punitive
Damages: In strictly limited circumstances, you can recover punitive damages,
if appropriate.
